TERMS AND CONDITIONS

1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Eric's Auto Repair ("Company," “we,” “us,” or “our”), concerning your access to and use of the ericservices.us website, as well as any other media form, media channel, mobile website, or related, linked, or otherwise connected thereto (collectively, the “Site”).

We are registered in Florida, United States, and have our registered office at 13 Enterprise Dr, Palm Coast, FL 32164.

By accessing the Site, booking a repair service, or purchasing products (parts, bicycles, or vehicles), you acknowledge that you have read, understood, and agree to be bound by all of these Terms and Conditions. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS AND CONDITIONS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND SERVICES.

2. REPAIR SERVICES AND APPOINTMENTS (AUTO & BIKE)

2.1. Florida Motor Vehicle Repair Act Compliance

In compliance with Florida Statutes (Section 559.901 et seq.), you have specific rights regarding vehicle repairs:

  • Written Estimates: For any repair work on a motor vehicle that exceeds $100.00, you are entitled to a written estimate. By booking an appointment online, you acknowledge that we may need to perform diagnostic work to provide this estimate.

  • Authorization: No work exceeding the estimate will be performed without your explicit authorization (written or oral).

  • Replaced Parts: You have the right to request the return of replaced parts, provided you request them before work begins, except for parts that must be returned to the manufacturer under a warranty or exchange agreement.

2.2. Booking and Cancellations

  • Booking System: Our online booking system is for convenience. While we aim to respect all scheduled times, appointment times are estimates and may be subject to delays due to the nature of repair work.

  • Cancellation Policy: You must cancel or reschedule appointments at least 24 hours in advance. Failure to do so may result in a Cancellation Fee of $25.00 or forfeiture of any booking deposit paid online.

  • No-Shows: If you fail to appear for your appointment without notice, we reserve the right to charge a "No-Show" fee equal to 50% of the estimated labor or $50.00, whichever is less.

2.3. Mechanics Lien & Storage Fees

  • Mechanic’s Lien: Pursuant to Florida law, Eric's Auto Repair asserts a lien on all vehicles and bicycles for the value of labor and parts supplied. We retain the right to hold possession of the vehicle or bicycle until the invoice is paid in full.

  • Storage Fees: If a vehicle or bicycle is not picked up within three (3) business days of notification of completion (or notification of estimate refusal), a storage fee of $35.00 per day for cars and $10.00 per day for bicycles will be added to the final invoice.

3. ONLINE STORE: PARTS, BIKES & PRODUCTS

3.1. Product Availability and Errors

We make every effort to display as accurately as possible the colors, features, specifications, and details of the auto parts, bike parts, and bicycles available on the Site. However, we do not guarantee that these details will be accurate, complete, reliable, current, or free of other errors. We reserve the right to discontinue any product at any time for any reason. Prices for all products are subject to change.

3.2. Orders and Payment

We accept payments via Wix Payments (Credit/Debit Cards) and other methods displayed at checkout. You agree to provide current, complete, and accurate purchase and account information for all purchases made via the Site. Sales tax will be added to the price of purchases as deemed required by the State of Florida.

3.3. Shipping and Risk of Loss

  • Shipping Areas: We currently ship parts and bicycles to addresses within the United States.

  • Risk of Loss: All items purchased from the Site are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier (USPS, UPS, FedEx, etc.).

3.4. Returns and Refunds

Please review our Refund Policy posted on the Site prior to making any purchases. Generally, electrical parts and special orders are non-refundable.

4. VEHICLE SALES (CARS)

4.1. "As-Is" Sale

Unless explicitly stated in a separate written warranty document provided at the time of sale, all vehicles sold by Eric's Auto Repair are sold "AS-IS, WHERE-IS" and "WITH ALL FAULTS." We hereby disclaim all warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.

4.2. Online Deposits for Vehicles

If the Site allows for a deposit to "hold" a vehicle, this deposit is non-refundable unless Eric's Auto Repair fails to produce the vehicle for sale. The payment of a deposit does not constitute the final sale; the final sale is contingent upon the completion of title transfer paperwork in person at our Palm Coast facility.

4.3. No Cooling-Off Period

Please be aware that under Florida Law, there is generally no "cooling-off" period for vehicle purchases. Once you have signed the contract and taken delivery of the vehicle, the sale is final.

5. USER REPRESENTATIONS

By using the Site, you represent and warrant that:

  1. All registration information you submit will be true, accurate, current, and complete.

  2. You have the legal capacity and you agree to comply with these Terms and Conditions.

  3. You will not access the Site through automated or non-human means, whether through a bot, script, or otherwise.

  4. You will not use the Site for any illegal or unauthorized purpose.

6. PROHIBITED ACTIVITIES

You may not access or use the Site for any purpose other than that for which we make the Site available. As a user of the Site, you agree not to:

  • Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.

  • Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email.

  • Engage in unauthorized framing of or linking to the Site.

7. LIMITATION OF LIABILITY

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFIT, LOST REVENUE, LOSS OF DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF THE SITE OR OUR REPAIR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Specific to Repairs: We are not responsible for any loss or damage to your vehicle or articles left in your vehicle in case of fire, theft, accident, or any other cause beyond our control while the vehicle is in our custody.

8. INDEMNIFICATION

You agree to defend, indemnify, and hold us harmless, including our subsidiaries, affiliates, and all of our respective officers, agents, partners, and employees, from and against any loss, damage, liability, claim, or demand, including reasonable attorneys’ fees and expenses, made by any third party due to or arising out of: (1) use of the Site; (2) breach of these Terms and Conditions; or (3) your violation of the rights of a third party.

9. DISPUTE RESOLUTION

These Terms shall be governed by and defined following the laws of the State of Florida. Eric's Auto Repair and yourself irrevocably consent that the courts of Flagler County, Florida shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these terms.
